Legislation

Abortion is legal up to birth in South Australia under the Termination of Pregnancy Act 2021.

According to the Act:

  • Before 23 weeks gestation, a medical practitioner may abort a preborn child without any restrictions. Abortion pills may also be prescribed/administered by a nurse practitioner or another authorised health practitioner.
  • After 23 weeks gestation, a preborn child may be aborted if two medical practitioners agree that: a) the abortion is necessary to save the life of the mother or another unborn child or b) the continuance of the pregnancy would pose significant risk of injury to the mother's physical or mental health or c) the unborn child has, or there is significant risk that the unborn child has, a serious fetal anomaly. These broad categories for consideration make it easy for a woman in South Australia to abort her child up to birth.
  • In an emergency, a single medical practitioner may abort a preborn child of 23 weeks gestation or more without consulting a second medical practitioner.

Buffer Zones Around Abortion Clinics

Part 5A of the Health Care Act 2008 places a 150 metre buffer zone around all abortion clinics (this does not include pharmacies).

Within a buffer zone, it is an offence to:

  • protest abortion laws
  • interfere with any person's access an abortion clinic (e.g. to attempt to dissuade someone from entering an abortion clinic)
  • record images of a person approaching, entering or leaving an abortion clinic

It is unclear whether silently praying inside a buffer zone is an offence.

Maximum penalty: $10,000 or imprisonment for 12 months
